Ardex Operations App: Terms of Use

The Ardex Operations App is private software built and operated by Ardex Group Ltd for running our own facilities services business. It is not sold, licensed or made available to the general public, and there is no public sign-up.

These terms govern its use. By signing in you accept them.

1. Who we are

Ardex Group Ltd is a company registered in England and Wales, company number 15701050, registered office Cn House, Brooks Drive, Cheadle Royal Business Park, Cheadle, Cheshire, SK8 3TD. In these terms, "we", "us" and "our" mean Ardex Group Ltd, and "the app" means the Ardex Operations App.

2. Who may use the app

Accounts are created by us. You may use the app only if we have given you an account, and only for the purpose it was given to you for. There are three kinds of user:

  • Our staff and managers, to see their rota, clock in and out, complete checklists, report incidents and manage the work.

  • Our customers, to see the schedule, instructions, reports and invoices for the sites they are responsible for.

  • Our administrators, to run the business.

You must not let anybody else use your account, and you must not use an account that was not given to you.

3. Your account

Keep your password to yourself and do not share it. Tell us straight away if you think somebody else has got into your account, or if you lose the device you use it on. We may suspend or close an account at any time, in particular when somebody leaves our employment or a contract with a customer ends.

4. Licence

While your account is active we grant you a personal, non-exclusive, non-transferable right to use the app for the purposes set out above. We keep ownership of the app and everything in it. You must not copy it, sell access to it, reverse engineer it, or try to extract its source code or data except through the features we provide.

5. Acceptable use

You must not:

  • Use the app in any way that breaks any applicable law or regulation

  • Enter anything into it that is false, defamatory, offensive or deliberately misleading, including clocking in or out at a time or place that is not accurate

  • Attempt to gain access to records you have not been given access to

  • Introduce viruses or anything else malicious or technologically harmful

  • Attempt to interfere with the app, its servers or its security

  • Take information out of the app and use or share it outside your work for us or your business relationship with us

Attempting unauthorised access may be a criminal offence under the Computer Misuse Act 1990. Your right to use the app ends immediately if you breach these terms.

6. Information in the app

The app holds information about people, including our staff and our customers' contacts. Treat it as confidential. Only look at what you need for your work, and do not share it outside the business.

What we do with personal information, and your rights over it, are set out in our Privacy Policy. Our staff are also given a separate staff privacy notice, which they accept in the app.

7. Connected services

The app connects to other services in order to work, including QuickBooks for accounting and payroll. Where we send information to those services, we do so to run the business and in line with our Privacy Policy. Those services have their own terms, which govern our relationship with them rather than yours.

8. Availability

We work to keep the app available but we do not guarantee that it will be uninterrupted or free of faults. We may change it, suspend it or withdraw features at any time, and we may take it offline for maintenance. Where a feature is used to record working time, you remain responsible for telling us about any hours that the app did not capture correctly.

9. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury arising from our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law. Nothing in these terms affects the statutory rights of our employees.

Subject to that, and to the extent permitted by law, we exclude all conditions, warranties and other terms that might otherwise be implied, and we are not liable for any indirect or consequential loss, or for loss of profits, business, goodwill or data, arising out of or in connection with use of, or inability to use, the app.

10. Changes to these terms

We may update these terms. Where a change materially affects you, we will tell you, and users of the app may be asked to accept the new version before carrying on.

11. Governing law

These terms, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them.
